Sometimes, the aggrieved party may decide to seek legal redress together, in the form of a class action lawsuit. This allows them to have one legal representative who will file their case. One of the main reasons of seeking a class action lawsuit is because it makes it possible for the members to file a case against large companies or manufacturers. It would be a difficult task for an individual to seek compensation from a large organization, but with several people in the same class action lawsuit, all attention will be on the case and they will get the redress needed. This arrangement also makes it possible to sue a number of organizations or parties in the same case.
For instance, if a group wants to file a class action lawsuit case because of the side effects from using a certain drug, the evidence presented will be sufficient because of the size of the group and all with medical facts pointing a finger at the manufacturer of the drug. In addition, a class action lawsuit takes the legal fees burden from one person and it is distributed in the group. Since some cases take a long time and they may go on for months and years, the fees will accumulate and once the group receives compensation through the class action lawsuit, they will not have a hard time getting money to meet the lawyer’s fees. This is the main expense when seeking legal counsel, though the firm will wait until the compensation is awarded in order to ask for the legal fees.
In essence, this is a wise decision because some people prefer not to make any claim because they cannot meet the legal fees. The amount received as compensation will be sufficient for all members and also for the legal fees in the class action lawsuit. This set-up allows both parties that are the plaintiffs and the defendants get the same ruling and compensation. It unifies all the evidence to come up with a ruling that will serve the benefit of all parties present. Hence, for a class action lawsuit, none of the plaintiffs will feel like they got a lower compensation than others who might not have a big claim.
On the same note, the hearing of a class action lawsuit is in one court and this limits any possibility of several decisions coming up when there are different judges presiding. When looked at from a wider perspective, there is safety in numbers and the chances of winning a class action lawsuit seems higher than pursuing the legal process individually. The members will offer each other support throughout the trial and they have a better chance of making the right decisions than is the case for one person. Some of the important choices they have to make relate to the choice of lawyers and the number of people they will have in the group seeking the class action lawsuit. A qualified lawyer will ensure that they follow the legal guidelines expected when filing such a case.
